RESOLUTION NO. RS2002-1293

A resolution authorizing and directing the Director of Public Property to exercise an option to purchase property (Tax Map 93-02, Parcel 24 – 432 Third Avenue North) for The Metropolitan Government of Nashville and Davidson County (Proposal No. 2002M-133U-09).

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

“Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council;” and

WHEREAS, Pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option to purchase certain property located in Davidson County on parcel 24 on tax map 93-02, as shown on Exhibit A and incorporated into this resolution by reference; and

WHEREAS, It is deemed in the best interest of the Metropolitan Government to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. That the Director of Public Property Administration is hereby authorized and directed to exercise the option to purchase the improved property (Tax Map 93-02, Parcel 24 – 432 Third Avenue North) as shown on Exhibit A and to execute the necessary documents pertaining thereto.

SECTION 2. That the funds for this option agreement will be taken from Fund No. 40150, BU 15901002.

SECTION 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
