RESOLUTION RS2017-853

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the resurfacing 5.58 miles on McCrory Lane, from State Route 100 to State Route 1 (Charlotte Pike), SA-19003(2).

WHEREAS, pursuant to the terms of said Agreement with the State of Tennessee, Department of Transportation (“TDOT”), attached to this resolution and incorporated herein as Exhibit A, TDOT agrees to appropriate and expend certain funds for State Aid Highway and Off-System Bridge Replacement projects and the Metropolitan Government of Nashville and Davidson County (“METRO”) agrees to match such expenditures up to two percent (2%) for State Aid Highway System projects and two percent (2%) for Off-System Bridge Replacement projects; and,

WHEREAS, the estimated cost for the McCrory Lane resurfacing is $1,134,000, which is shared 89% State and 11% Local, for a total estimated cost to METRO of $124,740.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104 authorizes the Metropolitan Government to enter into intergovernmental agreements with TDOT by resolution; and,

WHEREAS, approval of this agreement will benefit the citizens of the Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County and TDOT, attached hereto as Exhibit A, is hereby approved.

Section 2. That the amount of this agreement be appropriated to the Metropolitan Government Department of Public Works based on the revenues estimated to be received and any match to be applied.

Section 3. This resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
