RESOLUTION NO. RS2017-633

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, acting through the Department of Public Works, for the acceptance of work in connection with the construction of a State Industrial Access Road serving Centurion Stone, State Project No. 19960-3560-04, PIN 125278.00, Proposal No. 2017M-013PR-001.

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) plans to construct State Project No. 19960-3560-04, a State Industrial Access Road serving Centurion Stone, PIN 125278.00; and,

WHEREAS, to continue forward with the application for state funds, pursuant to this Agreement, Metro must agree to cover 50 percent of the estimated costs associated with the right-of-way phase for this construction project, or $88,800; and,

WHEREAS, a participation agreement between the Metropolitan Government and Centurion Stone, Inc., for the construction of the public infrastructure, wherein Centurion Stone, Inc. has agreed to pay 50 percent of the estimated cost associated with the right-of-way phase for this construction project, $88,800, is pending before the Metropolitan Council for approval; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County agrees to cooperate with TDOT as described in said Agreement, attached hereto as Exhibit A and incorporated by reference, so that said construction can occur; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville & Davidson County to approve an agreement with TDOT by resolution; and,

WHEREAS, it is in the interest of The Metropolitan Government of Nashville & Davidson County that the construction be carried out in State Project No. 19960-3560-04.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement with TDOT, attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.
