RESOLUTION NO. RS2017-563

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the Gladeville Utility District to provide information needed to bill sewerage customers for service in Davidson County.

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) is the operator of a sanitary sewer system, and the customers of Metro’s sewer system are charged service rates and fees as determined by Metro; and,

WHEREAS, the Gladeville Utility District (“Gladeville”) provides water services to a portion of the customers (“Joint Customers”) of Metro’s sewer system; and,

WHEREAS, both Metro and Gladeville have determined that it would be in their best interest and in the best interest of their Joint Customers, for Gladeville to provide water meter readings to Metro for Metro’s use in charging sewer system service rates and fees to the Joint Customers; and,

WHEREAS, the public health, safety and welfare require that Gladeville and Metro enter into an agreement by which Metro may terminate water service to Joint Customers who fail to pay the sewer system service rates and fees when Metro complies with the terms and conditions for such termination set forth in this Agreement; and,

WHEREAS, it is the best interests of The Metropolitan Government of Nashville and Davidson County to enter into said Agreement with Gladeville.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement by and between the Gladeville Utility District and The Metropolitan Government of Nashville and Davidson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute said Agreement.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
