RESOLUTION NO. RS2016-472

A resolution to amend Ordinance No. BL2014-784 to add one additional parcel to the list of those for which acquisition by negotiation and acceptance of permanent and temporary easements is authorized for construction of the I-40/I-440 South Sewer Relocation Project and to authorize the acquisition of said easement rights by condemnation (Proposal No. 2014M-010ES-002, Project No. 13-SG-0129).

WHEREAS, Ordinance No. BL2014-784, approved June 11, 2014, authorized the negotiation and acceptance of permanent and temporary easements for the I-40/I-440 South Sewer Relocation Project; and,

WHEREAS, permanent and temporary easements on one additional parcel, located at 437 36th Avenue North, are needed for the I-40/I-440 South Sewer Relocation Project; and,

WHEREAS, acquisition by condemnation may be needed to acquire easement rights for 437 36th Avenue North or for the other parcels identified in BL2014-784; and,

WHEREAS, Ordinance No. BL2014-784 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2014-784 is hereby amended to add one additional parcel, located at 437 36th Avenue North, to this list of those for which acquisition was authorized by the negotiation and acceptance of permanent and temporary easements for construction of the I-40/I-440 South Sewer Relocation Project, as listed below and shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the interests in real property described herein and in BL2014-784 in the name of the Metropolitan Government of Nashville and Davidson County for use in public projects for the Metropolitan Government.

Section 3. That the resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
