RESOLUTION NO. RS2016-471

A resolution approving an interlocal agreement by and between The City of Berry Hill and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the Multimodal Transportation Plan along SR6, from Berry Road to Lafayette Street.

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) and The City of Berry Hill (“Berry Hill”) seek to enter into an interlocal agreement for the Multimodal Transportation Plan along SR6, Franklin Pike and 8th Avenue South, from Berry Road to Lafayette Street; and,

WHEREAS, Berry Hill’s Multimodal Transportation Plan on SR6, from Berry Road to Wedgewood Avenue, is currently underway; and,

WHEREAS, Metro seeks to extend the Multimodal Transportation Plan on SR6 from Wedgewood Avenue to Lafayette Street or the roundabout; and

WHEREAS, both Berry Hill and Metro will create a Study Oversight Committee to oversee and direct the plan development; and

WHEREAS, the Metro participation for the Interlocal Multimodal Transportation Study along SR6 is $33,396; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this interlocal agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the interlocal agreement by and between The City of Berry Hill and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the Multimodal Transportation Plan along SR6 Franklin Pike and 8th Avenue South, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
