RESOLUTION NO. RS2016-470

A resolution approving an intergovernmental Agreement by and between the State of Tennessee, Department of Transportation, The City of Berry Hill and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the Multimodal Transportation Plan along SR6, from Berry Road to Lafayette Street, PIN 121988.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, The City of Berry Hill and the State of Tennessee, Department of Transportation seek to enter into an intergovernmental agreement Amendment 1 for the Multimodal Transportation Plan along SR6, Franklin Pike and 8th Avenue South from Berry Road to Lafayette Street , PIN 121988.00; and,

WHEREAS, the estimate for the Multimodal Transportation Study along SR6 is $321,978 which is shared $257,582 Federal, $31,000 City of Berry Hill and $33,396 Metro; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between the State of Tennessee, Department of Transportation, The City of Berry Hill and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the Multimodal Transportation Plan along SR6 Franklin Pike and 8th Avenue South, PIN 121988, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
