RESOLUTION NO. RS2016-283

A resolution declaring surplus and approving the disposition of that certain parcel of real property known as 0-Elberta Street, to the adjoining property owner (Proposal No. 2016M-018PR-001).

WHEREAS, the Metropolitan Government owns that certain real property identified as 0-Elberta Street and as further described in Exhibit A; and

WHEREAS, the primary residence of the adjoining owner at 100-Elberta Street, a single family home, was built on or around 1944 and encroaches onto said property known as 0-Elberta Street as shown on Exhibit B; and

WHEREAS, the property known as 0-Elberta Street was sold to the Metropolitan Government as the result of a title company’s error; and

WHEREAS, the title insurance company has agreed to pay the appraised, fair market value of the property to the Metropolitan Government of $7,200.00; and

WHEREAS, the Metropolitan Government has determined that this certain parcel of real property is not needed for any governmental purpose.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council declares the following parcel of land, owned in fee simple by the Metropolitan Government, and as described in the exhibit attached hereto and incorporated herein, to be surplus.

Section 2. The Director of Public Property is hereby authorized and directed to sell said property listed above.

Section 3. The proceeds from the sale of said parcel of property shall be credited to the General Fund of the district from whose operating budget the last department, commission, board or agency using the real property is financed.

Section 4. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
