RESOLUTION NO. RS2016-232

A resolution to execute a new contract to utilize unused funds from a grant previously approved by RS2011-1724 from the Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services to replace flood damaged properties that chose not to participate in the home buy-out with 15 properties including vacant lots located in various floodway floodplain areas in Davidson County.

WHEREAS, the Metropolitan Council previously enacted Ordinance BL2010-765 which authorized the Department of Water and Sewerage Services to apply for federal and state funds to acquire interests in and demolish flood-damaged properties pursuant to a hazard mitigation grant program upon approval of a resolution by the Metropolitan Council receiving at least twenty-one affirmative votes which identifies the specific parcels to be acquired and the maximum price to be paid for each parcel; and,

WHEREAS, Department of Water and Sewerage Services applied for and received a grant from the Tennessee Emergency Management Agency, which was approved by RS2011-1724, and the grant funds were not completely appropriated due to some homes choosing not to participate in the buy-out; and,

WHEREAS, the contract attached hereto authorizes the use of the previously granted unused funds in an amount not to exceed $2,235,557.41, with a required cash match of $319,365.40, to purchase and remove 15 properties that are replacing properties that withdrew from the original grant project; and,

WHEREAS, Department of Water and Sewerage Services has prepared the Metropolitan Government’s contract for this portion of the hazard mitigation grant program including identification of the specific parcels and the maximum amount to be paid for each parcel, including details on the specific parcels; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this contract be approved and submitted and that the Department of Water and Sewerage Services be authorized to acquire and demolish the specific properties included in the contract.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Government’s contract from the Tennessee Emergency Management Agency, for the purchase and removal of 15 houses located in various floodway and floodplain areas in Davidson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and Director of the Department of Water and Sewerage Services is authorized to sign and submit said contract to the Tennessee Emergency Management Agency.

Section 2. That, notwithstanding the provisions of Section 2.24.250.F of the Metropolitan Code to the contrary, Department of Water and Sewerage Services is hereby authorized to acquire interests in the real property identified in the contract, attached hereto and incorporated herein, and to execute all other necessary actions pursuant to the hazard mitigation grant program using federal and/or state grant funds received by the Metropolitan Government for such purpose.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
