RESOLUTION NO. RS2015-64

A resolution authorizing the Director of Public Property Administration to accept the donation of a parcel of property for public use (Proposal No. 2015M-038PR-001).

WHEREAS, the Metropolitan Code of Laws § 2.24.250(F) provides that fixed-price options for the acquisition of fee simple interest in real property to be used for certain purposes may be approved by resolution of the Metropolitan Council; and,

WHEREAS, pursuant to the document attached as Exhibit 1 and incorporated into this resolution by reference, Bellevue Development, LLC, proposes to donate a tract of land (the “Property”) to the Metropolitan Government for public use; and,

WHEREAS, the Property is shown as tract 3 on the proposed Subdivision Plat for Bellevue Place, attached as Exhibit 2 and incorporated into this resolution by reference; and,

WHEREAS, because of its location and characteristics, the Property is well suited for public use; and,

WHEREAS, acquisition of the Property is in the best interest of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That the Director of Public Property Administration is hereby authorized to accept the proposed donation of the Property by deed in form materially similar to the one attached as Exhibit 3 to this Resolution and to receive, execute and record such other documents as may be necessary to carry out acquisition of the Property.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
