RESOLUTION NO. RS2015-1619

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the acceptance of a traffic signal in connection with project RSAR SR-251, from Tidwell Road to South of Tolbert Road, including I-40 interchange, PIN 120239.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) and the State of Tennessee, Department of Transportation (“TDOT”) seek to enter into an intergovernmental agreement for the acceptance of a traffic signal in connection with project RSAR SR-251, from Tidwell Road to South of Tolbert Road, including I-40 interchange, PIN 120239.00.

WHEREAS, pursuant to the agreement Metro will be responsible for and pay all costs associated with the maintenance and operation of all accepted electrically operated devises, together with the related equipment, wiring and other necessary appurtenances; and

WHEREAS, pursuant to the agreement TDOT will furnish electrical current to all devices which may be installed as part of the project; and

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the acceptance of a traffic signal in connection with project RSAR SR-251, from Tidwell Road to South of Tolbert Road, including I-40 interchange, PIN 120239.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
