RESOLUTION NO. RS2015-1581

A resolution approving Amendment Number One (1) to an intergovernmental agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, for the addition of the Right of Way Phase to the Murfreesboro Pike Drainage Improvements project, Pin Number 121040.00.

WHEREAS, RS2014-1248 approved an intergovernmental agreement between the State of Tennessee, Department of Transportation (“TDOT”), and The Metropolitan Government of Nashville and Davidson County (“Metro”), for the Murfreesboro Pike Drainage Improvements project (the “Project”), including the Vultee Boulevard bridge removal and the Kermit Drive Intersection, Pin Number 121040.00 (the “Agreement”); and,

WHEREAS, the Agreement did not specify the responsible party for the right of way phase of the Project, and;

WHEREAS, the parties agree that Metro will be the party responsible for the right of way phase of the Project and wish to amend the Agreement to reflect the same, and;

WHEREAS, Exhibit A of the Agreement will be deleted in its entirety and replaced with Exhibit “A” to Amendment One (1), attached hereto, and;

WHEREAS, Section B.1, General Requirements, of the Agreement will be deleted in its entirety and replaced with Amendment One (1), which provides that Metro shall be responsible for the right of way phase, and;

WHEREAS, Amendment Number One (1) will approve the right of way phase of the Project with an estimated cost of $333,001.00, under Pin No. 121040.00; and,

WHEREAS, under Amendment Number One (1) the federal and State participation estimate for the Project is $3,700,000.00, under Pin No. 121040.00; and

WHEREAS, under Amendment One (1) Metro’s participation estimate for the Project is $2,333,001.00, under Pin No. 121040.00; and,

WHEREAS, RS2014-1248 authorized the approval of amendments to the agreement by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment Number One (1) to the Agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Number One (1) to the Agreement between TDOT and Metro for the addition of the right of way phase, PIN 121040.00, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That Amendment Number One (1) to the Agreement for PIN 121040.00 does not change maintenance responsibilities for either party when improvements are completed.

Section 3. That this resolution shall take effect from and after its adoption the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
