RESOLUTION NO. RS2015-1564

A resolution setting public hearings for the creation of the Bordeaux Redevelopment Plan and the creation of the Cayce Place Redevelopment Plan.

WHEREAS, the Metropolitan Development and Housing Agency desires to redevelop the area along County Hospital Road bordering the Bordeaux Hills residential community to the east, Metro Water-owned properties to the west, the Cumberland River to the south, and privately-owned parcels to the north; and

WHEREAS, the Metropolitan Development and Housing Agency also desires to redevelop the area bordered to the west by Interstate 24, to the south by Crutcher Street, to the east by the Shelby Hills neighborhood, and to the north by Shelby Avenue; and

WHEREAS, the projects are to be undertaken by the Metropolitan Development and Housing Agency in accordance with and in furtherance of the objectives of Section 13-20-201 through 209, Tennessee Code Annotated; and

WHEREAS, Section 13-20-203, Tennessee Code Annotated, requires a public hearing on any redevelopment plan prior to final approval being given by the Metropolitan Council; and

WHEREAS, the proposed plan will be referred by the Metropolitan Development and Housing Agency to the Metropolitan Council for its review and approval; and

WHEREAS, a legal notice stating the date, time and place of said public hearings must be published in a newspaper of general circulation in the locality where the project is situated.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That at the meeting of the Metropolitan Council to be held on Tuesday, July 21, 2015, at 6:30 p.m. in the Metropolitan Council Chamber in the Metropolitan Courthouse (One Public Square), the Council shall conduct a public hearing relative to implementing the Bordeaux Redevelopment Plan in the manner required by law, at which hearing any person or organization desiring to be heard regarding the proposed plan will be afforded such an opportunity.

Section 2. That at the meeting of the Metropolitan Council to be held on Tuesday, July 21, 2015, at 6:30 p.m. in the Metropolitan Council Chamber in the Metropolitan Courthouse (One Public Square), the Council shall conduct a public hearing relative to implementing the Cayce Place Redevelopment Plan in the manner required by law, at which hearing any person or organization desiring to be heard regarding the proposed plan will be afforded such an opportunity.

Section 3. That the Metropolitan Clerk is hereby directed to have published in The Tennessean, being the daily newspaper of general circulation in Nashville, Tennessee, in the issues of July 6, 13, and 20, 2015, legal notices declaring that the public hearing relative to implementing the Bordeaux Redevelopment Plan and the public hearing relative to implementing the Cayce Place Redevelopment Plan will be held at the time and place aforesaid in the manner prescribed by law after approval of said legal notice by the Metropolitan Attorney.

Section 4. That the Metropolitan Development and Housing Agency be and is hereby authorized and directed to give written notice of the public hearings to at least one of the owners or at least one of the occupants of each parcel of property within the area affected by the proposed redevelopment plans, as required by law.

Section 5. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
