RESOLUTION NO. RS2015-1491

A resolution approving an Intergovernmental Agreement by and between the Department of Army, Nashville District, Corps of Engineers, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for the acceptance of The First Supplemental Agreement, related to Easement No. DACW62-2-02-0308, for the placement of a drainage culvert and concrete headwall, within the J. Percy Priest Dam and Reservoir Project. (Proposal No. 2015M-023ES-001)

WHEREAS, Department of Army, Nashville District, Corps of Engineers has approved plans related to Easement No. DACW62-2-02-0308, for the extension of a 24-inch metal drainage culvert and concrete headwall, approximately 10-feet along the north side of Smith Springs Branch Road and the installation of a new 18-inch reinforced concrete pipe and headwall with approximately 8.5-feet on Corps Tract No. 1031, within the J. Percy Priest Dam and Reservoir Project; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County agrees to cooperate with the Department of Army, Nashville District, Corps of Engineers as described in said Agreement, attached hereto as Exhibit A and incorporated by reference, so that said easement can be accepted under Proposal No. 2015M-023ES-001; and,

WHEREAS, Resolution No. RS2002-1052, approved the original easement for DACW62-2-02-0308, on May 24, 2002; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville and Davidson County to approve an agreement with the Department of Army, Nashville District, Corps of Engineers by resolution; and,

WHEREAS, it is in the interest of The Metropolitan Government of Nashville and Davidson County to accept the First Supplemental Agreement related to Easement No. DACW62-2-02-0308, for the extension of a drainage culvert and concrete headwall, within the J. Percy Priest Dam and Reservoir Project.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the First Supplemental Agreement with the Department of Army, Nashville District, Corps of Engineers, attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2. That the First Supplemental Agreement with Department of Army, Nashville District, Corps of Engineers was approved under Proposal No. 2015M-023ES-001.

Section 3. That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
