RESOLUTION NO. RS2015-1489

A resolution authorizing the Director of Public Property to exercise an option to purchase two parcels of property (Parcel ID Nos. 10516020700 and 10516020900) for use as a public park by The Metropolitan Government of Nashville and Davidson County (Proposal No. 2015M-011PR-001) and the Director of Finance to accept a donation in the amount of $500,000.00 from Conexión Americas as a contribution towards purchase and development.

WHEREAS, Metropolitan Code of Laws § 2.24.250(F) provides that fixed-price options for the purchase of fee-simple interest in real property to be used for certain purposes may be approved by resolution of the Metropolitan Council; and

WHEREAS, pursuant to the terms of the option agreement (the “Option”) attached as Exhibit 1 and incorporated into this resolution by reference, the Director of Public Property proposes to purchase the tracts of land at 2187 Nolensville Pike (Parcel ID No. 10516020700) and 2138 Canady Avenue (Parcel ID No. 10516020900) (collectively, the “Properties”), together comprising approximately 0.80 acres; and

WHEREAS, because of their location and characteristics, the Properties are well-suited for use as a public park and the Metropolitan Board of Parks and Recreation has recommended their acquisition; and

WHEREAS, as described in the letter attached to this resolution as Exhibit 2, Conexión Americas propose to donate $500,000.00 (the “Donation”) to the Metropolitan Government as a contribution towards the purchase and development of the Properties; and

WHEREAS, purchase of the Properties and acceptance of the Donation is in the best interest of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That the Director of Public Property Administration is hereby authorized to exercise the Option and to receive, execute and record such documents as may be necessary to carry out the purchase of the Properties.

Section 2. That the Director of Finance is authorized to accept the Donation for use in the purchase and development of the Properties.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
