RESOLUTION NO. RS2015-1471

A resolution approving an Intergovernmental Agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for the acceptance of traffic signal improvements in connection with construction at S.R. 6, Franklin Pike, at the Intersection at Harding Place and Battery Lane, State Project No: 19022-221-54, Federal Project No: STP-M-6 (84).

Whereas, the State of Tennessee, Department of Transportation (“TDOT”) plans to construct State Project No: 19022-221-54, Federal Project No: STP-M-6 (84) at S.R. 6, Franklin Pike at the Intersection at Harding Place and Battery Lane, including traffic signal improvements at said intersection; and,

Whereas, The Metropolitan Government of Nashville and Davidson County agrees to cooperate with TDOT as described in said Agreement, attached hereto as Exhibit A and incorporated by reference, so that said construction can occur; and,

Whereas, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville and Davidson County to approve an agreement with TDOT by resolution; and,

Whereas, it is in the interest of The Metropolitan Government of Nashville and Davidson County that the construction be carried out in State Project No: 19022-221-54, Federal Project No: STP-M-6 (84).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement with TDOT, attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
