RESOLUTION NO. RS2015-1467

A resolution approving an intergovernmental agreement by and between the Tennessee Bureau of Investigation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, authorizing the MNPD Crime Lab Director to serve as representative of the Director of the TBI.

WHEREAS, the intergovernmental agreement between the Metropolitan Nashville Police Department and the Tennessee Bureau of Investigation, attached hereto, allows the Director of the TBI to authorize the MNPD Crime Lab Director to serve as representative to receive requests and certify test results of MNPD criminal cases involving toxicology; and,

WHEREAS, Tennessee Code Annotated Section 12-9-104 provides that interlocal agreements between political subdivisions of the State and agencies of the State may be approved by Resolution; and,

WHEREAS, it is in the interest of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between the Tennessee Bureau of Investigation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, that allows the Director of the TBI to authorize the MNPD Crime Lab Director to serve as representative to receive requests and certify test results of MNPD criminal cases involving toxicology, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
