RESOLUTION NO. RS2015-1412

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims Clarisse Sweat (also known as “Karissa” Sweat) has brought against Joe Shelton, a Metropolitan Government Police Officer, and the Metropolitan Government, in the amount of $50,000.00 to be paid out of the Judgment and Losses Fund.

WHEREAS, Clarisse Sweat filed a wrongful death suit against Police Officer Joe Shelton and the Metropolitan Government alleging constitutional violations stemming from the shooting death of Reginald Wallace on March 12, 2010, and also filed a negligence claim against the Metropolitan Government arising out of the same incident.

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and particularly its employee Joe Shelton, and recommends that the claims of Clarisse Sweat be compromised and settled for $50,000.00 and that this amount be paid from the Judgments and Losses Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Clarisse Sweat for the sum of $50,000.00 to be paid out of the Judgment and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
