RESOLUTION NO. RS2015-1389

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims Pamela DeSoto has brought against the Metropolitan Government of Nashville and Davidson County and Metropolitan Government employees Tommy Lynch, Chris Taylor, Bryan Irvin, Kevin Hooper, Danny Duke, Jerry Moore, Johnny Perry, Tom Harbison, Foster Hite, in the amount of $295,000, of which $30,000 is for back pay to be paid out of the Parks operating budget. The remaining $265,000 is to be paid out of the Judgment and Losses Fund.

WHEREAS, Pamela DeSoto, a Parks Police employee, filed suit against the Metropolitan Government and Tommy Lynch, Chris Taylor, Bryan Irvin, Kevin Hooper, Danny Duke, Jerry Moore, Johnny Perry, Tom Harbison, Foster Hite, all Metropolitan Government employees, and is alleging employment discrimination, constitutional violations, and defamation stemming from her decommissioning on May 6, 2013 and demotion from Sergeant to Officer.

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the claims of Pamela DeSoto be compromised and settled for $295,000 and that this amount be paid as follows: $30,000 in back pay to be paid out of the Parks operating budget, and $265,000 from the Judgments and Losses Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Pamela DeSoto for the sum of $295,000 of which $30,000 is for back pay to be paid out of the Parks operating budget. The remaining $265,000 is to be paid out of the Judgment and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
