RESOLUTION NO. RS2015-1362
A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury and property damage claims of Ms. Elizabeth Moss and State Farm Mutual Automobile Insurance Company, as subrogee for Elizabeth Moss, against the Metropolitan Government of Nashville and Davidson County in the amount of $11,038.06, and that said amount be paid out of the Self-Insured Liability Fund.
WHEREAS, on July 19, 2013, Ms. Moss was a passenger in her vehicle that was involved in an accident on Murfreesboro Road near Hamilton Church Road. The cause of the accident was a Metropolitan Government employee’s failure to stop his vehicle in time to prevent coming into contact with the back end of her vehicle; and,
WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the personal injury and property damage claims of Elizabeth Moss and the claims of State Farm Mutual Automobile Insurance Company be compromised and settled for $11,038.06 and that this amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Ms. Moss and State Farm Mutual Automobile Insurance Company, as subrogee for Elizabeth Moss, for the sum of $11,038.06 with said amount to be paid out of the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
