RESOLUTION NO. RS2014-1304

A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase real property for use in a public project for the Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new Fire Station in the Charlotte Pike area (Proposal No. 2014M-026PR-001).

WHEREAS, expansion of the Nashville Fire Department system enhances protection for Davidson County residents; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council; and,

WHEREAS, pursuant to the terms of the option attached as Exhibit A and incorporated into this resolution by reference, the Metropolitan Government holds an option to purchase unimproved property (Parcels 302.00 and 435.00, of Davidson County Tax Map 092-10-0 of the Metropolitan Government's official records; the "Property") located near Charlotte Pike and suited for use in expanding the fire protection system; and,

WHEREAS, the Nashville Fire Department has approved the purchase of the Property; and,

WHEREAS, it is in the best interest of the citizens of the Metropolitan Government to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to exercise the option to purchase the property (Parcels 302.00 and 435.00, of Davidson County Tax Map 092-10-0) as shown in Exhibit A and to execute the necessary documents pertaining thereto.

Section 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.

Section 3. All property rights herein authorized to be acquired shall be paid from funds authorized from Business Unit No. 32403014.
