RESOLUTION NO. RS2014-1267

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claims of Richard Parker, Margaret Parker, and James Cordray and the property damage claims of Werner Enterprises against the Metropolitan Government of Nashville and Davidson County in the amount of $265,000.00, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on November 28, 2011, Mr. Parker was driving a tractor-trailer and Mr. Cordray was driving a tractor on I40 West near Fesslers Lane in the right hand lane. A police car owned by the Metropolitan Government and operated by a police officer crossed several lanes of traffic, cutting off the vehicle driven by Mr. Parker and resulting in a multi-vehicle accident. The accident caused personal injury to Mr. Parker and Mr. Cordray and property damage to the tractor Mr. Cordray was driving, which was owned by Werner Enterprises; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the personal injury claims of Richard Parker, Margaret Parker, and James Cordray and the property damage claims of Werner Enterprises be compromised and settled for a total of $265,000.00 and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Richard Parker, Margaret Parker, and James Cordray and the property damage claims of Werner Enterprises for the sum of $265,000.00 with said amount to be paid out of the Self- Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
