RESOLUTION NO. RS2014-1265

A resolution approving an intergovernmental license agreement by and between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Arts Commission, in relation to the Korean Veterans Boulevard Roundabout (Proposal No. 2014M-003OT-001).

WHEREAS, the Metropolitan Nashville Arts Commission desires to use a portion of the Korean Veterans Boulevard Roundabout to install public art; and,

WHEREAS, the State of Tennessee is willing to permit the installation of public art on this public right-of-way; and,

WHEREAS, pursuant to the terms of the intergovernmental license agreement with TDOT, attached hereto as Exhibit A, The Metropolitan Government of Nashville and Davidson County accepts a license to install and maintain a public art within the State right of way; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental license agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The intergovernmental license agreement between The Metropolitan Government of Nashville and Davidson County and TDOT, attached hereto and incorporated herein as Exhibit A, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
