RESOLUTION NO. RS2014-1251
A resolution authorizing the continued parking of vehicles at the former Stokes Middle School property located at 3701 Belmont Boulevard pursuant to Section 2.206.010 of the Metropolitan Code.
WHEREAS, the Metropolitan Board of Public Education (“the Board”) maintains control over the former Stokes Middle School property located at 3701 Belmont Boulevard; and
WHEREAS, the Board has permitted Lipscomb University to use the former Stokes Middle School property for overflow parking of vehicles; and
WHEREAS, the use of the former Stokes Middle School property for parking is technically not a permissible use of the property under the Metropolitan Zoning Code; and
WHEREAS, Section 2.206.010 provides that Metropolitan Government departments, agencies, boards or commissions shall have the authority to be exempted from compliance with provisions of the Metropolitan Code for just cause upon adoption of a resolution of the Metropolitan Council approved by twenty-one affirmative votes; and
WHEREAS, on September 18, 2012, the Metropolitan Council adopted Resolution No. RS2012-428 to authorize the use of the former Stokes Middle School property located at 3701 Belmont Boulevard for the overflow parking of motor vehicles by Lipscomb University for a period not to exceed two (2) years; and
WHEREAS, the Metropolitan Council desires to approve an extension of this parking arrangement for a period extending through June 30, 2018, subject to approval of the Metropolitan Board of Public Education.
NOW, THEREFORE BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY THAT:
Section 1. Pursuant to Section 2.206.010 of the Metropolitan Code, the Metropolitan Council hereby approves the use of the former Stokes Middle School property located at 3701 Belmont Boulevard for the continued overflow parking of motor vehicles by Lipscomb University for a period extending through June 30, 2018, subject to entering into an agreement with the Metropolitan Board of Public Education detailing the terms and conditions for the use of the former Stokes Middle School Property.
Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Metropolitan Board of Public Education and to the Director of the Department of Codes Administration.
Section 3. This Resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
