RESOLUTION NO. RS2014-1248

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Departments of Public Works and Water and Sewer Services, for State Route-1 (Murfreesboro Pike) from Vultee Boulevard to Jupiter Drive, including the Vultee Boulevard Bridge and Intersection on State Route-1at Kermit Drive PIN 121040.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, acting by and through the Departments of Public Works and Water and Sewer Services, and the State of Tennessee, Department of Transportation, seek to enter into an intergovernmental agreement for State Route-1(Murfreesboro Pike) including drainage correction and improvements from Vultee Boulevard to Jupiter Drive, removal of the Vultee Boulevard Bridge, and intersection improvements with signalization with State Route-1 and Kermit Drive, under the National Highway Performance Program and State Betterment Program in Davidson County, PIN 121040.00; and,

WHEREAS, pursuant to the terms of the agreement as further described in Exhibit A, State of Tennessee, Department of Transportation, through the State Betterment Program, will participate and manage the PE NEPA Phase with an estimated cost of $200,000 and construction phases with an estimated cost of $1,000,000 under PIN 121040.00; and,

WHEREAS , pursuant to the terms of the agreement described in Exhibit A, the State of Tennessee, Department of Transportation, through the National Highway Performance Program, will participate and manage in the construction phase the Environmental Mitigation with 80 percent Federal and 20 percent State funding with an estimated cost of $2,000,000 and Construction –CEI phase with an estimated cost of $500,000 under PIN121040.00; and,

WHEREAS, pursuant to the agreement described in Exhibit A, the Metropolitan Government will participate in the construction phase with estimated cost of $2,000,000 under PIN 121040.00; and,

WHEREAS, pursuant to the agreement, Paragraph D.9 Maintenance, nothing contained herein shall be construed as changing the maintenance responsibilities of the project for either party on the State Highway System. However, the Metropolitan Government will continue to be responsible for the maintenance and the furnishing of electrical current for any traffic signal device or lighting devices installed under PIN121040.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, for State Route-1 (Murfreesboro Pike) from Vultee Boulevard to Jupiter Drive, including the Vultee Boulevard Bridge and Intersection State Route-1 at Kermit Drive, PIN 121040.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the Metropolitan Departments of Public Works and Water and Sewer Services shall furnish design plans and contribute $2,000,000 for the Metropolitan Government’s construction share under PIN121040.00.

Section 3. That The Metropolitan Government, pursuant to this intergovernmental agreement, shall be maintain the traffic signals for State Route-1 (Murfreesboro Pike) improvements under PIN 121040.00.

Section 4. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 5. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
