RESOLUTION NO. RS2014-1246

A resolution authorizing The Metropolitan Government of Nashville and Davidson County, herein after referred to as “Metro”, to enter into an agreement with the City of Goodlettsville, hereinafter referred to as “Goodlettsville”, for Metro’s reading of water consumption meters and for disconnecting and reconnecting water service to Goodlettsville’s sewer customers.

WHEREAS, Goodlettsville provides sewer transportation and treatment services to a portion of Metro’s water customers within the city limits of Goodlettsville; and,

WHEREAS, the Metropolitan Department of Water and Sewerage Services has requested that Metro enter into the Agreement, attached hereto and incorporated herein, with Goodlettsville under which Metro would read water consumption meters and submit such readings to Goodlettsville each month for a fee of forty-five cents ($0.45) per separate water consumption meter reading; and,

WHEREAS, Metro and Goodlettsville agree that upon the failure of a Goodlettsville sewer customer to pay such sewer rates and fees, Metro would disconnect as well as reconnect services, as needed, and will charge Goodlettsville such fees; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., ("The Interlocal Cooperation Act") authorizes political subdivisions of the state to enter into cooperative agreements by resolution of the local governing body; and,

WHEREAS, it is in the best interests of The Metropolitan Government of Nashville and Davidson County to enter into the Agreement between Metro and Goodlettsville.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement, attached hereto and incorporated herein, by and between The Metropolitan Government of Nashville and Davidson County and the City of Goodlettsville is hereby approved, and the Director of the Metropolitan Department of Water and Sewerage Services is authorized to execute said Agreement.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
