RESOLUTION NO. RS2014-1245

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for miscellaneous safety improvements on State Route 45, Old Hickory Boulevard intersection at State Route 265, Central Pike under the Highway Safety Improvement Program in Davidson County, PIN 121073.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation seek to enter into an intergovernmental agreement to include miscellaneous safety improvements for State Route 45, Old Hickory Boulevard intersection at State Route 265, Central Pike under the Highway Safety Improvement Program in , PIN 121073.00; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County is required to accept the miscellaneous safety improvements including signal, signing, pavement markings, handicap ramps, and pedestrian upgrades on SR45, Old Hickory Boulevard intersection at SR 265, Central Pike under the Highway Safety Program, in PIN 121073.00; and,

WHEREAS, pursuant to the terms of the agreement described on Exhibit A, the State of Tennessee, Department of Transportation’s estimated share for miscellaneous safety improvements on SR45, Old Hickory Boulevard intersection at SR265, Central Pike is $191,050.00, under the Highway Safety Program, in PIN 121073.00; and,

WHEREAS, pursuant the terms of the agreement described in Exhibit A, The Metropolitan Government of Nashville and Davidson County through the Department of Public Work’s estimated share for miscellaneous safety improvements on SR45, Old Hickory Boulevard intersection at SR265, Central Pike is $191,050.00 under the Highway Safety Program in PIN 121073.00; and,

WHEREAS, pursuant the agreement, Paragraph D.9 Maintenance, nothing contained herein shall be construed as changing the maintenance responsibilities of the project for either party on the State Highway System. However, The Metropolitan Government of Nashville and Davidson County will continue to be responsible for maintenance and furnishing of electrical current for any traffic signal device or lighting devices installed under PIN 121040.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes The Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for miscellaneous safety improvements on SR45, Old Hickory Boulevard intersection at SR265, Central Pike, under the Highway Safety Program in, PIN 121073.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That The Metropolitan Government, pursuant to this intergovernmental agreement, shall maintain the traffic signals on State Route 45, Old Hickory Boulevard Intersection, at SR265, Central Pike.

Section 3. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
