RESOLUTION NO. RS2014-1180

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the City of Belle Meade for the acceptance and treatment by the Metropolitan Government of Nashville and Davidson County of sewage flow from the City of Belle Meade’s sewage collection system and Amendments to existing Agreements with the following: City of Brentwood for Amendment One to an Agreement for sewage treatment; City of Goodlettsville for Amendment One to an Agreement for sewage treatment; City of La Vergne for Amendment Two to an Agreement for sewage treatment; City of Millersville for Amendment One to an Agreement for sewage treatment.

WHEREAS, The Metropolitan Government of Nashville and Davidson County owns and operates a sewage transportation and treatment system (the “Metro System”); and, the City of Belle Meade owns and operates sewage collection system (the “Customer System”); and,

WHEREAS, the Metro System has or will have sufficient capacity to safely and effectively accept and treat sewage flows from the Customer Systems as contemplated; and,

WHEREAS, the City of Belle Meade Board of Commissioners authorized the Agreement attached hereto at a Special Meeting on July 1, 2014; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the City of Brentwood (as approved by RS2009-943), the City of Goodlettsville (as approved by RS2010-1375), the City of La Vergne (as approved by RS2011-1703), and the City of Millersville (as approved by RS2010-112) individually entered into an agreement relating to the transportation and treatment of sewage flows from Customer’s System; and,

WHEREAS, the parties desire to amend their individual agreements to adjust the rates and terms to achieve compliance with existing Agreements; and,

WHEREAS, the City of Brentwood Board of Commissioners authorized Amendment One to the Agreement, attached hereto, by passage of Brentwood Resolution No. 2014-49 on July 14, 2014; and,

WHEREAS, the City of Goodlettsville Board of Commissioners authorized Amendment One to the Agreement, attached hereto, on June 26, 2014; and,

WHEREAS, the City of LaVergne Board of Mayor and Aldermen authorized Amendment Two to the Agreement, attached hereto, on July 1, 2014; and,

WHEREAS, the City of Millersville Board of Commissioners authorized Amendment One to the Agreement, attached hereto; on June 17, 2014, and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., ("The Interlocal Cooperation Act") authorizes political subdivisions of the state to enter into cooperative agreements by resolution of the local governing body; and,

WHEREAS, it is the best interests of The Metropolitan Government of Nashville and Davidson County to enter into said individual Agreements and Amendments with the City of Belle Meade, the City of Brentwood, the City of Goodlettsville, the City of La Vergne, and the City of Millersville.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement by and between the City of Belle Meade, Amendment One to the Agreement by and between the City of Brentwood, Amendment One to the Agreement by and between the City of Goodlettsville, Amendment Two by and between the City of La Vergne, amendment One by and between the City of Millersville, and The Metropolitan Government of Nashville and Davidson County, copies of which are attached hereto and incorporated herein, are hereby approved, and the Metropolitan Mayor is authorized to execute said Agreements.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
