RESOLUTION NO. RS2014-1127

A resolution adopting a new pay plan for the general employees of The Metropolitan Government of Nashville and Davidson County, excluding employees of the Board of Health, Board of Education and the Fire and Police Departments, effective January 1, 2015; and establishing the salary for the Public Defender, effective upon the beginning of a new elective term for that office.

WHEREAS, the Metropolitan Civil Service Commission, has, pursuant to Section 12.10 of the Metropolitan Chatier, assigned each employment classification to a salary grade as of January 1, 2015, with such assignments being equitably related to each other; and,

WHEREAS, the Civil Service Commission has adopted the salary ranges for each grade; and, WHEREAS, the Director of Personnel for the Civil Service Commission has recommended, after the Commission's approval, desirable salary ranges for each grade to the Director of Finance; and,

WHEREAS, pursuant to RS2013-711, a new pay plan was approved by the Metropolitan Council to go into effect on January 1, 2014; and,

WHEREAS, the pay plan that was adopted pursuant to RS2013-711 included increment pay increases that are earned at various time intervals; and,

WHEREAS;it is the desire for these increment increases to continue; and,

WHEREAS, it is further the desire that employees, who are paid pursuant to open pay ranges, be eligible, at the discretion of the employee's Appointing Authority, to receive merit pay increases;

WHEREAS, the Metropolitan Civil Service Commission has recommended that the pay plan approved under RS2013-711 be amended to allow a salary increase for all employees of The Metropolitan Government of Nashville and Davidson County, excluding employees of the Board of Health, Board of Education and the Fire and Police Departments, in the amount of one (1.0%) percent, with such increase becoming effective as of January 1, 2015; and,

WHEREAS, the Metropolitan Civil Service Commission, through the Metropolitan Department of Human Resources, conducted a salary structure survey study during FY14 to determine if changes needed to be made to the cunent salary structure used by the Metropolitan Government, including determining the relationship of pay assigned to Metropolitan Government employment classifications compared to similar positions in the market and with comparable governmental entities; and,

WHEREAS, the salary survey revealed various pay issues that need to be addressed both now and in the future; and,

WHEREAS, the Metropolitan Civil Service Commission determined an immediate need to address specific job classifications which are greater than 20% below median market rates when compared to similar positions in the market and with comparable governmental entities; and,

WHEREAS, upon review it has been recommended by the Civil Service Commission that the salary for the position of Public Defender, set pursuant to RS2006-1452, should be adjusted so that it is comparable with the salary paid to the District Attomey General, which is set by the State of Tennessee; and,

WHEREAS, pursuant to § 18.05 of the Metropolitan Charter the salary of the Public Defender shall not be increased or diminished during the period for which that individual shall have been elected; and,

WHEREAS, the salary proposed by this legislation can only become effective at the beginning of a new elective term for the position of Public Defender; and,

WHEREAS, the Civil Service Commission further recommended that the Part-Time/Seasonal Pay Table needed to be adjusted so that the maximum (per game) range for the classification of Sports Official was increased so that quality officials could be obtained; and,

WHEREAS, the Director of Finance has approved the recommendations of the Civil Service Commission and forwarded the same with a statement of full budgetary implications to the Mayor for his approval; and,

WHEREAS, the Mayor has approved the plan and recommends its adoption by the Metropolitan County Council.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The pay plan adopted pursuant to RS2013-711 and which went into effect on January 1, 2014, for the general employees of the Metropolitan Govemment, excluding employees of the Board of Health, Board of Education, and the Fire and Police Depa1iments, from and after January 1, 2015, shall be as provided in Exhibit A. Exhibit A reflects a salary increase in the amount of one (1.0%) percent and the continuation of increment increases. Exhibit A is incorporated into this Resolution as if fully set out herein.

Section 2: Additional funding shall be provided to each department in the amount of two (2.0%) percent of that depa1iment's total annual open range salary budget so that employees in open range pay classifications will have the opportunity to receive merit based salary increases, at the discretion of the Appointing Authority, as reflected in Exhibit A. Open range salary increases for FY15 will be effective as of January 1, 2015.

Section 3: Employees in the classifications identified by the salary survey as being greater than 20% below median market rates when compared to similar positions in the market and comparable govemmental entities shall be given a three (3.0%) percent salary increase as of January 1, 2015. These classifications, as approved by the Metropolitan Civil Service Commission, are reflected in Exhibit B which is incorporated into this Resolution as if fully set out herein.

Section 4: The annual salary for the position of Public Defender shall be $148,505. This change in compensation, approved by this resolution, shall be effective on the first day of the next elective term for the position of Public Defender.

Section 5: The maximum "per game" pay for the position of Sports Official, identified as No. 09108 and listed in the Patt-Time/Seasonal Pay Table, is increased to $65.00.

Section 6: This Resolution shall take effect on July 1, 2014, the welfare of The Metropolitan Government ofNashville and Davidson County requiring it.
