RESOLUTION NO. RS2013-943

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Brick Church Pike intersection improvements at Chesapeake Drive under the Highway Safety Improvement Program in Davidson County, PIN 118215.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation seek to enter into an intergovernmental agreement to include the construction for Brick Church Pike intersection improvements at Chesapeake Drive, under the Highway Safety Improvement Program in Davidson County, PIN 118215.00; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County is required to accept a General Maintenance Agreement from the State of Tennessee, Department of Transportation, for Brick Church Pike intersection improvements at Chesapeake Drive, under the Highway Safety Program in Davison County, PIN 118215.00; and,

WHEREAS, the Brick Church Pike intersection at Chesapeake Drive project includes the installing of various signs, snowplowable markers, reflectors, chevrons, thermoplastic white and yellow lines, guardrails, and other safety improvements in Davidson County PIN 118215.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Brick Church Pike intersection improvements at Chesapeake Drive under the Highway Safety Program in Davidson County, PIN 118215.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That The Metropolitan Government pursuant to this intergovernmental agreement shall maintain the safety improvements for Brick Church Pike intersection at Chesapeake Drive.

Section 3. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
