RESOLUTION NO. RS2013-914

A resolution authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Departments of Water and Sewerage Services and Public Works, to participate in a project with the Electric Power Board of the Metropolitan Government of Nashville and Davidson County for repair of approximately 500 feet of eroded pond bank along Great Circle Road in Nashville for the protection of the roadway and utilities within the public right-of-way.

WHEREAS, pursuant to the terms of the document (the “Agreement”) attached and incorporated into this resolution and attached as Exhibit A, the Metropolitan Government of Nashville and Davidson County, acting by and through the Departments and Water and Sewerage Services and Public Works, and the Electric Power Board of the Metropolitan Government of Nashville and Davidson County (“NES”) propose to jointly engage in a project (the “Project”) for repair of approximately 500 feet of eroded pond bank along Great Circle Road in Nashville for the protection of the roadway and utilities within the public right-of-way; and,

WHEREAS, pursuant to the terms of the Agreement, NES agrees to reimburse half of the Metropolitan Government’s anticipated costs associated with the Project up to $49,999.00; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes the approval of cooperative agreements between local government entities by resolution; and,

WHEREAS, the Agreement will benefit Nashville and Davidson County.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The participation agreement (Exhibit A) is hereby approved.

Section 2. The Metropolitan Government’s share of Project costs shall be borne equally by the Departments of Water and Sewerage Services and Public Works.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
