RESOLUTION NO. RS2013-904

A resolution to provide compensation for special judges presiding in Davidson County General Sessions Court.

WHEREAS, Tennessee Code Annotated Section 16-15-209 provides that a county legislative body, by resolution adopted by a two-thirds (2/3) vote, may authorize the payment of compensation to a special judge presiding in Davidson County General Sessions Court; and,

WHEREAS, there are situations that arise from time to time where an elected general sessions judge finds it necessary to be absent from court or cannot preside on a particular case, and this statute allows for the appointment of a special judge;

WHEREAS, retired general sessions judges have expressed a willingness to serve as special judges in Davidson County; and,

WHEREAS, it is in the best interest of the citizens of Davidson County that this resolution be approved.

Now, therefore, be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1. That the Council of the Metropolitan Government of Nashville and Davidson County hereby approves the appointment and compensation of part-time special judges for the Davidson County General Sessions Court, pursuant to the terms and circumstances set forth in Tennessee Code Annotated Section 16-15-209 and state law.

Section 2. Appropriate record keeping procedures will be instituted by the General Sessions Court Administrator, in cooperation with the Finance Department. Time and travel records along with supporting documentation will be maintained to identify those persons entitled to compensation and to support the reimbursement of any associated travel expenses.

Section 3. The amount of compensation for a special judge shall not exceed the rate of compensation for the other Davidson County General Sessions Court Judges, and travel expenses shall be reimbursed in accordance with Tennessee Code Annotated Section 16-15-209.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
