RESOLUTION NO. RS2013-896

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claims of Jacquelyn and Marvin Winnett against the Metropolitan Government of Nashville and Davidson County in the amount of $51,225.00, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on December 15, 2009, Jacquelyn Winnett was driving westbound on Old Hickory Boulevard; and,

WHEREAS, Lexie Brake, a Metro Water employee driving a Metro Water truck, attempted to change lanes and struck Mrs. Winnett’s vehicle on the driver’s side; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that the claim be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Jacquelyn and Marvin Winnett for the sum of $51,225.00. This amount shall be paid out of the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
