RESOLUTION NO. RS2013-895

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claims of Edward Swafford against the Metropolitan Government of Nashville and Davidson County in the amount of $17,844.64, and that said amount be paid out of the Self-Insured Liability Fund.

WHEREAS, on January 12, 2012, Edward Swafford was in his vehicle and stopped at a red light on Gallatin Pike at the intersection of Due West Avenue; and,

WHEREAS, Emily McClintock, a Nashville Fire Department employee, while driving a Metro ambulance in the course and scope her employment, struck Mr. Swafford’s vehicle from behind while Mr. Swafford was stopped at the red light; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that the claim be compromised and settled.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Edward Swafford for the sum of $17,844.64. This amount shall be paid out of the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
