RESOLUTION NO. RS2013-892

A resolution amending BL2013-534 to add the abandonment of approximately 158 feet of an existing sewer easement that was retained under O97-925 to abandon Alley 888 for various properties located along Cartwright Street and Charlotte Avenue (MWS Project No. 13-SL-37 and Proposal No. 2013M-036ES-001).

WHEREAS, the additional abandonment of approximately 158 feet of an existing sewer easement that was retained under O97-925 to abandon Alley 888 for various properties located along Cartwright Street and Charlotte Avenue is needed to construct MWS project number 13-SL-37; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-036ES-001 on July 2, 2013, for BL2013-534 and noted the additional abandonment of said sewer easement on August 29, 2013.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon the additional sewer easement that was retained under O97-925 to abandon Alley 888 for the properties located below as shown on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this resolution.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
