RESOLUTION NO. RS2013-885

A resolution authorizing the Director of Public Property, or his designee, to exercise options to acquire 3 flood impacted properties by purchase for use as park land (Proposal No. 2013M-031PR-001).

WHEREAS, pursuant to the terms of the agreements attached hereto and incorporated herein as Exhibits A-1, A-2, and A-3, the Metropolitan Government holds options to purchase certain properties (as shown on Exhibits B-1 and B-2); and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:
Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and,

WHEREAS, the Metropolitan Council previously passed RS2011-1671 which amended the Metropolitan Government’s Action Plan for Disaster Recovery to increase the Community Development Block Grant (CDBG) funds available to the Metropolitan Government for disaster relief and authorized the Metropolitan Development and Housing Agency to administer those CDBG Disaster Recovery funds on behalf of the Metropolitan Government; and,

WHEREAS, CDBG Disaster Recovery funds are available for the purchase of the properties identified in Exhibits A-1, A-2, and A-3; and,

WHEREAS, the Metropolitan Board of Parks and Recreation has approved the acceptance of these Properties; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the purchase of said property;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Director of Public Property, or his designee, is hereby authorized to exercise the options to purchase those properties known as 2340 Antioch Pike, 2360 Antioch Pike in Antioch, TN (also known as Davidson County Tax Map 148-01 Parcels 067.00 and 069.00) and 1016 Beech Bend Dr. in Nashville, TN (also known as Davidson County Tax Map 156-01 Parcel 001.00) as respectively described in Exhibits A-1, A-2 and A-3 and to execute the necessary documents pertaining thereto.
Section 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
