RESOLUTION NO. RS2013-877

A resolution authorizing the Metropolitan Department of Law to compromise and settle the property damage claim of the Gerdau Company against the Metropolitan Government of Nashville and Davidson County for the amount of $45,545.08, and directing that this amount be paid from the Self-Insured Liability Fund.

WHEREAS, on May 11, 2013, a sewer backup damaged the property (“Property”) of the Gerdau Company; and,

WHEREAS, the backup resulted from an accumulation of grease and debris in the main sewer line serving the Property; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the Metropolitan Government’s best interest, and recommends that the property damage claim be compromised and settled for $45,545.08, and this that amount be paid from the Self-Insured Liability Fund; and,

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the property damage claim of the Gerdau Company for the sum of $45,545.08 with said amount to be paid from the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
