RESOLUTION NO. RS2013-848

A resolution approving an Intergovernmental agreement between the METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, the ELECTRIC POWER BOARD OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, and the UNITED STATES COAST GUARD for access to 800-MHZ for emergency radio dispatching and response.

WHEREAS, The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the Electric Power Board of The Metropolitan Government of Nashville and Davidson County ("NES") jointly own and operate an emergency radio dispatch and response system utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission ("FCC"); and,

WHEREAS, the United States Coast Guard (“U.S. Coast Guard”), which is within the United States Department of Homeland Security, performs certain public safety functions; and

WHEREAS, the U.S. Coast Guard wishes to have access to the 800-MHZ radio frequencies licensed to the Metropolitan Government and NES; and,

WHEREAS, the Metropolitan Government, NES and the U.S. Coast Guard have agreed upon the terms of an Intergovernmental agreement to allow the Coast Guard interoperability access to the 800-MHZ radio frequencies; and,

WHEREAS, Tennessee Code Annotated, section 12-9-104, provides that agreements between governments may be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Intergovernmental Agreement by and between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and the United States Coast Guard for interoperability access to the 800-HMZ radio frequencies licensed to the Metropolitan Government and NES for public safety and governmental purposes, a copy of which agreement is attached hereto and incorporated herein, be and the same is hereby approved, and the Metropolitan Mayor is hereby authorized to execute said Intergovernmental Agreement.

Section 2. That this Resolution shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
