RESOLUTION NO. RS2013-833

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into Utility Relocation Contract No. 8041 with the State of Tennessee, Department of Transportation, to construct PIN Number 112302.00, Bridge 19-SR-254-2.54 Over Otter Creek, located in Davidson County (State Project No. 19057-4221-04 and MWS Project No. 09-WG-42).

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”) plans to construct Project No. 19057-4221-04, PIN Number 112302.00, Bridge 19-SR-254-2.54 Over Otter Creek, located in Davidson County, which will require the relocation of utilities as described in the attached contract; and,

WHEREAS, the Metropolitan Department of Water and Sewerage Services plans to construct the utility work identified as Project No. 09-WG-42 in Capital Improvement Budget No. 09WS0016 as described in the attached contract; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b), authorizes The Metropolitan Government of Nashville and Davidson County to approve an agreement with TDOT by resolution; and,

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 8041, attached hereto as Exhibit A, the Metropolitan Government of Nashville and Davidson County will be responsible for one hundred percent (100%) of the actual cost for the utility work, which is currently estimated to be $68,900.00. This amount is expected to be funded from existing balances on deposit in the Metropolitan Department of Water and Sewerage Services Local Government Investment Pool (“LGIP”) account with the State of Tennessee; and,

WHEREAS, it is in the interest of the Metropolitan Government of Nashville and Davidson County that this utility work be carried out in State Project No. 19057-4221-04.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Utility Relocation Contract No. 8041 with TDOT, attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.

Section 2. That the Director of Water and Sewerage Services is authorized to complete and sign additional documents necessary to implement the Local Government Investment Pool Program, relative to this State project.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
