RESOLUTION NO. RS2013-809

A resolution adopting a Substantial Amendment to the 2013-2018 Consolidated Plan for Housing and Community Development and 2013 Annual Action Plan and authorizing the Metropolitan Mayor to submit the Substantial Amendment to the U.S. Department of Housing and Urban Development.

WHEREAS, the U.S. Department of Housing and Urban Development (“HUD”) requires local governments seeking federal assistance through the Community Development Block Grant (“CDBG”), HOME Investment Partnerships (“HOME”), Emergency Solutions Grant (“ESG”), and Housing Opportunities for Persons with AIDS (“HOPWA”) programs to develop a Consolidated Plan for Housing and Community Development; and

WHEREAS, by Resolution R94-1396, the Metropolitan Council designated the Metropolitan Development and Housing Agency (“MDHA”) as the lead agency responsible for the preparation of the Consolidated Plan for Housing and Community Development programs for The Metropolitan Government of Nashville and Davidson County; and

WHEREAS, in March 2013, the Metropolitan Council approved Ordinance No. BL2013-383 adopting the 2013-2018 Consolidated Plan for Housing and Community Development and 2013 Annual Action Plan and authorizing the Metropolitan Mayor to submit the 2013-2018 Consolidated Plan to the U.S. Department of Housing and Urban Development; and

WHEREAS, actual allocations differ from estimated allocations and prior year funds are to be reprogrammed to other activities, which require a budget revision and allow the creation of new activities; and

WHEREAS, the methodology for selecting the priority neighborhood under the Place-Based Strategy priority has been developed and available programs identified; and

WHEREAS, proposed budget revisions, the addition of new activities, and refinement of the Place-Based Strategy constitute a Substantial Amendment to the 2013 – 2018 Consolidated Plan and 2013 Annual Action Plan; and

WHEREAS, HUD allows substantial amendments to the Five Year Consolidated Plan and the current year Action Plan providing the public participation process as outlined in the Consolidated Plan is followed; and

WHEREAS, the Public Comment period began on July 1, 2013 and concluded on August 1, 2013, and a public hearing was held on July 23, 2013; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Council adopts the Substantial Amendment to 2013-2018 Consolidated Plan for Housing and Community Development and 2013 Annual Action Plan, attached hereto and made part of this Resolution, and that the Metropolitan Mayor is authorized to submit the Substantial Amendment to HUD; and

Section 2. That a description of the Annual Action Plan for Program Year 1 (April 1, 2013 through March 31, 2014) for the expenditure of CDBG, HOME, ESG, and HOPWA funds is included in the Substantial Amendment; and

Section 3. That MDHA is authorized to administer the Consolidated Plan on behalf of The Metropolitan Government of Nashville and Davidson County; and

Section 4. That the local match required for the Emergency Solutions Grant will be provided by local non-profit organizations selected as sub-grantees. The twenty-five percent local match for the HOME Investment Partnerships Program will be provided by non-federal funds utilized for HOME projects as well as value of donated land or improvements associated with HOME-funded projects, or by other eligible methods as provided in the HOME regulations; and

Section 5. That CDBG, HOME, ESG, and HOPWA funds shall not be used for any property acquisition for which the power of eminent domain is utilized by MDHA; and

Section 6. That the Metropolitan Council expressly withholds any approval for the expenditure of funds for any project or for the administrative costs associated with the Community Development Block Grant program. All requested program expenditures shall be submitted to the Council for final approval by Resolution. And further, detailed project plans for capital improvements shall be on file in the Community Development Department of MDHA at the time of the filing of the Resolution; and

Section 7. The expenditure of CDBG, HOME, ESG, and HOPWA funds shall be in accordance with applicable federal regulations and reporting standards pertaining to the procurement of goods and services from women, minority-owned, small, and small businesses and individuals

Section 8. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
