RESOLUTION NO. RS2013-803

A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase real property (Map 119-07-0 Parcels 045.00 and 046.00) for the use and benefit of the Metropolitan Department of Parks and Recreation (Proposal No. 2013M-029PR-001).

WHEREAS, pursuant to the terms of the agreement attached hereto and incorporated herein as Exhibit A to this resolution, the Metropolitan Government holds an option to purchase certain residential properties known as approximately 4.99 acres at 0 Old Glenrose Avenue; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and,

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated the option (Exhibit A) to acquire real property located in Davidson County being approximately 4.99 acres and known as Tax Map No. 119-07-0 Parcels 045.00 and 046.00, as shown and attached hereto and incorporated herein as Exhibit B; and,

WHEREAS, the Metropolitan Board of Parks and Recreation has approved the acquisition of the property; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County that the purchase of this property be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Director of Public Property Administration, or his designee, is hereby authorized to execute the necessary documents to acquire the property identified as Parcels 045.00 and 046.00 on Davidson County Tax Map 119-07-0, and as shown in Exhibit B hereto.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
