RESOLUTION NO. RS2013-757

A resolution approving the annual nonrefundable excess garbage and rubbish fee set by the Metropolitan Department of Public Works.

WHEREAS, Metro Code Section 10.20.220.G provides that the Metropolitan Department of Public Works “may collect and dispose of excess garbage and rubbish within the urban services district upon request for such service by the owner and payment of a fee, such fee to be the actual cost for providing such service, including the cost of providing containers and the cost of billing and collection of said fee as determined by the department and approved by the metropolitan council by resolution[;]” and,

WHEREAS, the Metropolitan Department of Public Works has set a nonrefundable annual fee of seventy-five dollars ($75.00) per additional garbage and rubbish cart beginning with the third cart; and,

WHEREAS, the fee will be billed annually beginning in June of 2013 and covering the year between July 1, 2013 and June 30, 2014; and,

WHEREAS, the citizens of Nashville and Davidson County will benefit from the Metropolitan County Council approving the annual nonrefundable excess garbage and rubbish fee set by the Metropolitan Department of Public Works.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The annual nonrefundable excess garbage and rubbish fee set by the Metropolitan Department of Public Works at seventy-five dollars ($75.00) for each additional cart beginning with the third cart is approved, and the Department of Public Works is authorized to send bills in June of 2013 for the year between July 1, 2013 and ending June 30, 2014.

Section 2. This resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
