RESOLUTION NO. RS2013-751

A resolution authorizing the Director of Public Property, or his designee, to exercise an option to purchase real property known as Davidson County Tax Map 042-00-0 Parcel 040.00 for recreational use in the parks system (Proposal No. 2013M-019PR-001).

WHEREAS, pursuant to the terms of the agreement attached hereto and incorporated herein as Exhibit A to this Resolution, the Metropolitan Government holds an option to purchase certain property known as 0 Old Hickory Blvd. in the City of Madison (also known as Davidson County Tax Map 042-00-0 Parcel 040.00); and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and,

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (EXHIBIT A) to acquire real property located in Davidson County being Map No. 042-00, Parcel 040.00 (see EXHIBIT B), and incorporated into this resolution by reference; and

WHEREAS, the Metropolitan Board of Parks and Recreation has approved the acceptance of the Property; and,

WHEREAS, this property will be used as park land adding to the existing Cedar Hill Park in Madison; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the purchase of said property;

METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY: NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE

Section 1. That the Director of Public Property, or his designee, is hereby authorized to exercise the option to purchase the property known as 0 Old Hickory Blvd. in Madison, TN (also known as Davidson County Tax Map 042-00 Parcel 040.00) as described in Exhibit A and to execute the necessary documents pertaining thereto.
Section 2. That this resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
