RESOLUTION NO. RS2013-745

A resolution approving Amendment One (1) to an Agreement by and between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, for intersection improvements to Jefferson Street.

WHEREAS, the Metropolitan Council previously adopted and approved Agreement No. 080019 by and between Tennessee Department of Transportation (“TDOT”) and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department (“Metropolitan Government”), through resolution, RS2008-245.

WHEREAS, based upon said Agreement, TDOT awarded to the Metropolitan Government a grant in an amount not to exceed $920,808.00 with a required match of $480,203.00 by the Metropolitan Government, for intersection improvements to Jefferson Street; and,

WHEREAS, the parties desire to amend the Agreement in order to extend the term of the Agreement to June 1, 2017; specifically identify the two (2) intersections on Jefferson Street which are to be improved, 28th Avenue / Ed Temple and 21st Avenue North; and to better reflect TDOT’s current fund descriptions.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment One (1) to the Agreement for Jefferson Street Intersection Improvements, a copy of which is attached hereto and incorporated herein, by and between TDOT and the Metropolitan Government, acting by and through its Department of Public Works, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
