RESOLUTION NO. RS2013-675

A resolution approving a memorandum of understanding between the Metropolitan Government, acting by and through the Metropolitan Agricultural Extension Board to work cooperatively with the University of Tennessee.

WHEREAS, sections 11.801 and 11.802 of the Metropolitan Charter create the Agricultural Extension Board and set out the functions and duties of the Agricultural Extension Board (“the Board”); and,

WHEREAS, among those duties are to exercise all the powers and perform all the duties of the county Agricultural Extension Committee provided for by Tennessee Code Annotated, section 49-50-104, and otherwise to carry out the purpose of sections 49-50-101 to 49-50-106 of Tennessee Code Annotated by cooperating with the United States Department of Agriculture and the appropriate agencies of the State of Tennessee; and,

WHEREAS, under the Charter, the Board is to employ and fix the compensation of such personnel as may be necessary, within the limitations of its budget appropriation and funds otherwise available, and perform such other duties as may be imposed upon the board by ordinance; and,

WHEREAS, in keeping with these charter provisions, the Agricultural Extension Board cooperates with the University of Tennessee, which also cooperates with Tennessee State University, both agencies of the state as contemplated under state law; and,

WHEREAS, the Board employs and fixes the compensation of its personnel in coordination with both universities and the compensation for such employees is funded both by budget appropriations of the Metropolitan Council, as well as, other sources including funding from the universities as contemplated under the Metropolitan Charter; and,

WHEREAS, the Board and the University of Tennessee desire to enter into an memorandum of understanding setting out the terms and conditions under which the parties will operate beginning July 1, 2013 and continuing annually thereafter; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this memorandum of understanding be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council hereby approves this memorandum of understanding between the Metropolitan Government, acting by and through the Metropolitan Agricultural Extension Board, and the University of Tennessee to provide agricultural extension services to Davidson County as authorized by state law.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
