RESOLUTION NO. RS2013-660

A resolution authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services (“MWS”), to enter into an agreement to participate with the Metropolitan Development and Housing Agency (“MDHA”) to improve Stormwater infrastructure in the Haynes Park and Maynor Place neighborhoods of Davidson County, Tennessee in accordance with MWS Project No. 12-SWC-174 and MWS Project No. 12-SWC-131.

WHEREAS, pursuant to the terms of the agreement, attached as Exhibit A, MWS and MDHA propose to improve Stormwater infrastructure in the Haynes Park and Maynor Place neighborhoods of Davidson County, Tennessee; and,

WHEREAS, pursuant to the Memorandum of Understanding, by and between the Metropolitan Government of Nashville and Davidson County and MDHA, dated on or about May 10, 2012, attached as Exhibit B, the Metropolitan Government stated that its departments, agencies, and officers would promptly undertake and diligently pursue the 2010 recovery tasks and responsibilities contemplated for it in the Action Plan for Disaster Recovery and related Amendments (said Memorandum of Understanding henceforth referred to as the “Metro MOU”); and,

WHEREAS, pursuant to the Metro MOU, the Haynes Park and Maynor Place neighborhoods under the jurisdiction of MDHA were identified for repair and reconstruction of Stormwater infrastructure (the “Stormwater Projects”); and,

WHEREAS, MDHA and MWS find it necessary and convenient to enter into this agreement to state each entity’s responsibilities moving forward with the Stormwater Projects; and,

WHEREAS, this participation agreement is deemed to benefit both parties and the general community.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, and the Metropolitan Development and Housing Agency (“MDHA”) to improve Stormwater infrastructure in Davidson County, Tennessee, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewerage Services is authorized to execute the same.

Section 2. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
