RESOLUTION NO. RS2013-645

A resolution authorizing the Metropolitan Government of Nashville and Davidson County to enter into a consolidation agreement with the Old Hickory Utility District.

WHEREAS, the Metropolitan Government and Old Hickory Utility District (“OHUD”) own and operate separate water treatment and distribution systems (the “Metro System” and the “OHUD System,” respectively) that serve adjacent portions of the Old Hickory area of Davidson County; and,

WHEREAS, OHUD has determined that the Metropolitan Government can more efficiently and effectively provide water service within OHUD’s current service area; and,

WHEREAS, as provided in Tenn. Code Ann. §§ 7-82-202(e) and pursuant to the terms of the agreement (the “Agreement”) attached and incorporated into this resolution as Exhibit A, the Metropolitan Government and OHUD propose to consolidate OHUD’s System into Metro’s System; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes the governing bodies of political subdivisions of the state to approve cooperative agreements by resolution; and

WHEREAS, it is in the best interests of the Metropolitan Government that the Agreement be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government requiring it.
