RESOLUTION NO. RS2013-641

A resolution approving an agreement between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metro Department of Public Works, to install a traffic signal at SR 255 (Donelson Pike) intersection at Allen Road and Old Elm Hill Pike.

WHEREAS, the Tennessee Department of Transportation (“TDOT”) has allocated certain funds for traffic signal installation at SR 255 (Donelson Pike) intersection at Allen Road and Old Elm Hill Pike; and,

WHEREAS, said signal installation has been approved by the Metropolitan Traffic and Parking Commission; and,

WHEREAS, the Metropolitan Government (“Metro”), in recognition of the benefits to be received from said traffic signal installation, agrees to provide electricity and maintenance; and,

WHEREAS, T.C.A. § 12-9-101 et seq., authorizes local governments to enter into such agreements upon approval of local government by Resolution.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the agreement by and between TDOT and Metro, to install a traffic signal at SR 255 (Donelson Pike) intersection at Allen Road and Old Elm Hill Pike, Agreement No. 130034, Pin No. 114274.00, a copy of which agreement is attached, is hereby approved, and the Metropolitan Mayor is authorized the execute the same.

Section 2. That any further amendments to this legislation may be processed by resolution.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
