RESOLUTION NO. RS2013-602

A resolution approving an amendment to the contract, approved by RS2011-1756, for services by and between the United States Department of the Army and the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, for the Phase 3 Watershed Modeling in Davidson County, Tennessee and authorizing all necessary officials to execute the same.

WHEREAS, the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, previously entered into a contract for the Watershed Modeling Study with the United States Department of the Army, as approved by Council in RS2011-1756; and,

WHEREAS, due to this expansion in the scope of the modeling into the Stones River and J. Percy Priest tributaries, there will be additional costs; and,

WHEREAS, the original agreement with the United States Department of the Army requires that Metro consent any time the original scope is modified; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that such amendment be accepted.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That said amendment to the contract by and between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to update the frequency and flow analysis in the Stones River and J. Percy Priest Dam and improve the real time simulation modeling tool, a copy of which amendment is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
