RESOLUTION NO. RS2013-590

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s property damage claims against Josette Amsilli.

WHEREAS, on December 27, 2009, two Metropolitan Police Department vehicles operated by Metropolitan Government employees were traveling north on Bell Road when one vehicle was sideswiped by a south bound vehicle operated by Josette Amsilli who then proceeded to strike the second Metropolitan Police Department vehicle, resulting in damage to both vehicles; and,

WHEREAS, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the Metropolitan Government accept payment in the amount of $15,924.00 for vehicle one and $12,073.46 for vehicle two as compensation for all damages to Metropolitan Government property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its property damage claims against Josette Amsilli in an amount totaling $27,997.46 which shall be deposited into an appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
